Question
What do I do if my renter doesn't pay morgage and the house is bought by the bank/real estate agents? The renter hasn't payed morgage and we are getting eveicted w/o our deposit etc. What can we do? I am the renter, sorry for confusing guys.

Confused. You are the renter, or the owner? YOu are the renter and you paid the rent to the owner and the owner did not pay the mortgage? And you are being evicted? About the only thing you can do is call the bank and see if you can stay.

Nothing. Why did you let the renter be responsible for the mortgage? That's your responsibility - you pay the mortgage and he pays rent. I can't believe I'm actually taking the time to answer this question. Would you give a stranger one of your credit cards and expect him to pay the bill every month?

You are not clear. I have never heard of a renter paying the mortgage directly. If the renter hasn't paid, then who is being evicted? by whom? If there is a mortgage, then it can't be "bought" by bank without foreclosure proceedings. i suspect you are using the wrong terms, but I don't know what you are trying to ask.

Renters do NOT pay mortgages, they pay rent. Property buyers pay mortgages , they take out a loan to buy the house and are obligated to that loan. Property buyers do NOT have deposits . . . That would be renters . . . Your question is very confusing and hard to figure out what your situation is . . . renter ? OR mortgage payee ? If you are renters and delinquent in rent , you may forfeit deposits to cover back rent. If you are an owner , who rented it to someone else, you were always responsible for making the mortgage payment on your own, and collecting the rent from your renter separately. If you planned to skip paying the mortgage and try to let the renter do it directly, you make a veryyyyy bad mistake and now you may loose your house. The only way to save it would be to make the back payments , or the real owners (the bank) will take it back for delinquency.

Your right to occupy is junior to the mortgage. You have paid the rent and used the property. The owner collects the rent and does what they like with the rent. If you fail to pay they can evict you. When you move out the owner owes you the deposit. Somewhat unlikely that you will see it returned. You could consider not paying and seeing if the landlord takes any action. They could get an eviction order and then a judgment. You could likely argue that they have not been paying the mortgage so you are trying to recover your deposit. Not sure how a judge might see it.
